Policies 1. Rental day is each calendar day from the time the shipper (UPS/FedEx) attempts the first delivery to the Customer until that day the shipper (UPS/Fedex) returns the equipment to us. 2. Rental Period is noted on our invoice. Any extension requires the our express written consent. 3. Late Returns will be charged an additional rental fee of $50 for each day the equipment is returned late. Equipment not returned 5 days after the due date will be considered stolen and the customers’ credit card will be charged for the full recovery charges, replacement costs and accrued rental charges. Customer will also be liable for any charges incurred to recover merchandise not promptly returned when requested. Such charges will be in addition to the rental charges and/or the cost of equipment. At all times we retain title to all equipment rented to the customer and the right to end this lease and take possession of the equipment if it is not returned on request. 4. Equipment -- All equipments are examined and tested by prior to each rental. Any problems with equipment must be reported immediately (within two hours of receipt) to to be considered for an adjustment. No credit can be given if customer fails to notify us immediately. Any such credit will be at our sole discretion. 5. Security deposit -- A deposit, secured by Visa, MasterCard, of up to 100% of the replacement value of all equipment and accessories rented is required unless other arrangements have been made in advance. 6. Damage/Loss -- Customer bears all responsibility for any damage, loss, or theft of equipment. By taking possession of equipment, Customers agree that the equipment rented to you is in good and working condition. Customers agree to refuse to accept delivery and notify us and the shipper immediately of any visible damage or tampering with the shipping carton or product. In the event of damage, replacement of lost or damaged equipment, clean up and/or parts will be at the list price as stated by at the time of Rental. When equipment is destroyed or damaged, customers will also be liable for additional rental costs, accrued at the daily rate, until such equipment has been repaired or replaced. Such amounts may be above and beyond the deposits secured on the customers’ credit card. Any decision to replace or repair any or all equipment will be at the our sole discretion. We may, at our sole discretion, allow the customer to purchase such equipment. 7. Liability -- We assume no responsibility for damage to film, materials or other liability of any kind resulting from the use or malfunction of the equipment. Customer assumes all liability in usage of equipment. Our liability with respect to equipment availability and/or failure shall be limited to the rental rate for the current rental term. Customer also agrees to defend, indemnify and hold us, our affiliates, our employees and our agents of from all claims and expenses arising out of using our equipment. 8. Insurance -- Customer shall provide his/her own insurance to cover the replacement value at list price of all equipment for all theft, loss or damage. This includes purchasing shipping insurance coverage when returning the equipment to us. While our rental equipment is Customers possession, Customer is held completely liable for its condition. 9.Return of Equipment -- Acceptance by us of rental equipment upon return is not a waiver by us of any claims for latent or patent damage to the equipment. 10. Shipping Address -- We verify every card’s billing address and phone number before we ship your order to ensure it is really you who ordered it. Shipments to alternate addresses are only at our sole discretion . Customer assumes full responsibility for alternate address shipments regardless of who the delivery is made to. 11. Disclaimer -- All illustrations, descriptions and prices are intended to be correct. However clerical, typographical and printing errors are subject to correction. Prices are subject to change without notice. We reserve the right to correct errors and adjust prices or policies as needed. The The venue of any legal disputes concerning this contract is to be filed in Hennepin County, Minnesota. 12. Severability -- If any part of this Agreement is found to be void or unenforceable, it will not affect the rest of the Agreement, which shall remain valid and enforceable according to its terms. This Agreement is the only understanding between the Customer and Lessor. |
